I am not inclined to consider the prayer for bail since the quantity is commercial quantity and the investigation is ongoing.

In view of the provisions of section 36-A (4) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act) the period of ninety days to complete the investigation is extended to one hundred and eighty days, in the ordinary course and if the proviso is invoked, the period may be extended for a year, subject of course, to the Special Court reaching the satisfaction that it is expedient to do so after considering the report of the Public Prosecutor. 3.

The application is dismissed with liberty to the applicant to apply for bail afresh after the investigation is complete/charge-sheet is filed.
