By this application, the applicant has sought for condonation of delay of 318 days in challenging the judgment dated 23.03.2018 in Land Acquisition Case No. 138/2008.

Learned counsel for the respondents has opposed the application on the ground that no sufficient ground has been made out.

I perused the records and considered the submission advanced by the learned counsel for the respective parties. The applicants are an agriculturist and their agriculture land has been acquired. It is stated that they were unable to file the appeal within the limitation period due to financial constraint. 4.
The reasons stated in the application, in my considered view constitute sufficient grounds for condonation of delay. It is held in case of Dhiraj Singh (Dead) through LRs. and Others Vs. State of Haryana and others that Equities can be balanced by denying the appellants' interest for the period for which they did not approach the Court. Hence, the application is allowed. The delay in filing the appeal is condoned. The applicants shall not be entitled for interest during the delayed period i.e. from the date of impugned judgment till the date of the application.

Application stands disposed of.

Appeal be registered after removing office objection, if any.

Learned Assistant Government Pleader waives service of notice on behalf of respondent Nos. 1 and 2 and learned counsel for respondent No. 4 waives service of notice.
