The learned Advocate for the applicants / appellants states that delay in filing the appeal is because of the circumstances pointed out in the application and it is not deliberate. It is submitted that though according to the applicants / appellants, delay in filing the appeal is not deliberate, the applicants / appellants are willing to give up their claim of interest on the enhanced amount of compensation if granted by this Court for the period for which delay is caused. Accepting the above submission made on behalf of the applicants / appellants delay of 5497 days in filing the appeal is condoned. The civil application is allowed accordingly. No costs.
