Apprehending arrest in connection with Crime No.125/2017 registered for the offence punishable under Sections 254, 354-A, 323 and 506 of the Indian Penal Code, the applicant has sought pre-arrest bail.

The crime is registered on the complaint lodged by the complainant, aged about 19 years, that the applicant misbehaved with her, as stated in the complaint.

The application is opposed on the ground that the custody of applicant is required to recover the bag of complainant alongwith the items which were kept in the bag by the complainant.

The learned Advocate for the applicant has

2 aba319.17 pointed out that in the complaint lodged by the complainant there is no accusation that the applicant has snatched / taken away the bag of the complainant. The applicant, aged about 23 years, claims that he is serving in Coal Mines at Tawa in Madhya Pradesh. The applicant has further stated that he is not involved in any other crime / offence.

Considering the facts of the case, the following order is passed:

In the event of arrest in Crime No.125/2017 registered by the non-applicant, the applicant be released on bail on executing P.R. bond for Rs.20,000/- (Rs. Twenty Thousand).

The applicant shall provide his residential address of Tawa, Madhya Pradesh to the investigating agency within 2 weeks and in case the applicant shifts to another place, the address where the applicant shifts shall be provided to the investigating agency within 2 weeks of his shifting.

The applicant shall not enter Wani town till the filing of the charge-sheet except if summoned by the investigating agency.

The application is allowed in the above terms.
