Apprehending arrest in connection with Crime No.717/2017 registered for the offence punishable under Section 65(e) of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, the applicant seeks pre-arrest bail.

According to the investigating agency, on getting information the police party raided the spot, on seeing the police party the applicant fled away, however, stock of liquor is seized from the spot.

The application is opposed on the ground that investigation is in progress and custodial interrogation of applicant is required to unearth the truth and find out who else are involved in commission of crime. It is submitted that the applicant is a habitual offender and

2 aba320.17 crime for commission of similar offence is registered against the applicant.

This Court has passed an order on 9th May, 2017 granting protection to the applicant imposing condition of attendance at police station. The non-applicant has not made complaint that the applicant has not co-operated with the investigating agency. The non-applicant has not been able to point out that custody of applicant is required for further investigation. Considering the facts of the case, the following order is passed:

In the event of arrest in Crime No.717/2017 registered by the non-applicant, the applicant be released on bail on executing P.R. bond for Rs.25,000/- (Rs. Twenty Five Thousand) and furnishing one solvent surety in the like amount.

The application is allowed in the above terms.
