DATE : 08-07-2022 The applicant has approached to this Court by filing the present application under Section 439 of the Code of Criminal Procedure for grant of bail in connection with Crime No.0186/2022 dated 08-06-2022 registered with Police Station Patur, District Akola for the offences punishable under Sections 7 and 7A of the Prevention of Corruption Act, 1988. 2.

The learned Counsel for the applicant submits that the applicant has been falsely implicated in the alleged offence. He further submit that the applicant is in jail from last one month and considering the allegations made in the First Information Report, further custody of the applicant is not necessary. 3.

The learned APP strongly opposes the application. 4.

The applicant is in jail from last one month and the allegations are about acceptance of bribe.

Considering the nature of allegations and the severity of punishment, I am of the opinion that further custody of the applicant is not necessary. Moreover, there is nothing to show that if the applicant is released on bail, he will pressurize the prosecution witnesses or he will not be available for the trial. Hence, I pass the following order:

i) Application is allowed.

ii) It is directed that the applicant shall be released on bail in Crime No.186/2022 dated 08-06-2022 registered with Police Station Patur, District Akola for the offences punishable under Sections 7 and 7A of the Prevention of Corruption Act, 1988, on his furnishing P.R. Bond of Rs. 25,000/- with one solvent surety in the like amount. iii) The applicant shall attend the concerned Police Station as and when his present is required.
