The position of this applicant in the present case being the same as that of some of his co-accused, who are already released on bail, is clearly discernible from the facts that while this applicant has been identified and has been responsible for recovery of cash amount from his house as well as from his Bank account and has criminal antecedents, the other co-accused, particularly Rohit has also the similar situation in the sense that wooden log has been recovered from him, that he has been identified and that he too has criminal antecedents. Similar is the situation of Likhil @ Lucky as well as Krunal, who have already been granted bail under Section 439 Cr.P.C. There

2 1509ba445.16 is no reason why this applicant be deprived of similar benefit on the ground of parity. The application is, therefore, allowed .

It is directed that the applicant be released on bail on his furnishing a P. R. Bond in the sum of Rs.20,000/- together with one solvent surety in the like amount on the conditions that he shall regularly attend the Court proceedings on the dates fixed in the matter, shall cooperate with the Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses.
