Heard Shri Sunil V. Manohar, learned Senior Advocate with Shri Nikhil A. Gaikwad, learned counsel for the petitioners and Mrs. B.P. Maldhure, learned AGP for the respondents.

For the reasons separately recorded in the judgment, writ petition is allowed as the proprietary food sold by the petitioners could not have been examined by applying standards falling under Item A-14 of appendix B to the Prevention of Food Adulteration Rules, 1955. With the result, no action criminal or otherwise can be taken against the petitioners on the basis of said report at Annexure E. The said report at Annexure E is quashed and set aside.
