JAIN, JJ DATE : 3.8.2015 The petitioner challenges the order passed by the learned Tribunal rejecting application for condonation of delay. Delay is more than ten years. The ground for delay was that the applicant was suffering from Amnesia with General debility. The applicant had relied on the certificate of Dr. Tirpude. Doubting correctness of the certificate, learned Tribunal had directed the Civil Surgeon as well as the Chairman of the Medical Board to examine the certificate issued by Dr. Tirpude. The Civil Surgeon as well as the Chairman of the Medical Board found that said Dr. Tirpude is only an ordinary M.B.B.S. and not having specialized training or Post Graduate Degree of Psychiatric and as such was not competent to issue said

We do not find that any error is committed by the learned Tribunal in rejecting the application for condonation of delay. On the contrary, the learned Tribunal has gone out of way to consider and examine as to whether the certificate issued by Dr. Tirpude was genuine or not. Hence, petition is rejected.
