The petitioners are various Junior Colleges who conduct courses in XIth and XIIth std, Higher Secondary Schools and Colleges who are aggrieved by the decision of inclusion of their institutions in the Central Admission Process. It is their grievance that such Higher Secondary Schools/Junior Colleges within the limits of Nagpur Municipal Corporation are not entitled to be included in the Central Admission Process. They seek to rely upon the statistics for the year 2020-2021 to urge that under the Central Admission Process large number of seats at Schools and Junior Colleges in Nagpur have remained vacant insofar as Standard XI is concerned. Similar representation was made by them on 26/07/2021 with the State Government. In this backdrop the present writ petition has been filed.

30-WP-2887-21 2/2 It is submitted by the learned counsel for the petitioners that the petitioners have been discriminated by continuing their inclusion in the Central Admission Process in the area of Nagpur Municipal Corporation. It is submitted that insofar as Aurangabad Division is concerned, the same has been excluded from such process. Reply has been filed on behalf of the respondent Nos.1 and 3 justifying the need of including the limits of Nagpur Municipal Corporation in the Central Admission Process. Be that as it may, we find that the petitioners had made a representation dated 26/07/2021 seeking deletion of the area of Nagpur Municipal Corporation for the Central Admission Process. This was for the academic session 2021-2022.

With passage of time, we find that interests of justice would be met if the petitioners are permitted to make a fresh representation to renew its request as made in the writ petition for the academic year 2023-2024. If such representation is made within a period of four weeks, the respondent No.1 shall consider the same in accordance with law within a period of eight weeks of receiving such representation. The decision taken be communicated to the petitioners. Order accordingly. The Writ Petition is disposed of with aforesaid directions. No costs.
