Heard Shri R.S. Renu, learned counsel for the petitioner and Shri S.M. Uke, learned APP for the State. Seen affidavit vide St. No.981 of 2015 filed by the petitioner. In paragraph Nos.2 and 3 of the affidavit he has given undertaking that he would not disturb the traffic nor obstruct smooth running traffic in any manner whatsoever while running his business.
We are, therefore, satisfied with the affidavit filed by the petitioner. Impugned notice dated 9.6.2014 issued under Section 101/117 of the Bombay Police Act needs to be quashed and set aside.
Hence, in view of the undertaking Rule is made absolute in terms of prayer clause (i) of the writ petition. JUDGE JUDGE !! BRW !!
