In view of the provisions of Section 4 of the Limitation Act, 1963, office objection as regard to limitation is waived.
After hearing Shri Naik, learned Counsel for the applicant, it is noted that the findings recorded in paragraph 12 of the impugned judgment acquitting the accused are cryptic. Further more, the observation that the presumption under Sections 118 and 139 of the Negotiable Instruments Act is discharged, in my opinion, needs reconsideration. In view thereof, leave to file the appeal is granted. Criminal Appeal No._______/2016 :
