Khubalkar, Adv. for the petitioner. CORAM : Z.A. HAQ, J.
DATE : 14.9.2015 The grievance of the petitioner is that the directions given by this Court in the judgment delivered in Writ Petition No.1852/2004 on 5th February, 2015 have not been complied with by the respondent - Management.
Shri M.R. Pillai, advocate for respondents 1 and 2 has submitted that the above referred judgment was challenged by the Management before the Hon'ble Supreme Court, however, leave is not granted and after dismissal of the special leave petition, the petitioner is reinstated in service on 1st July, 2015.
2 cp161.15 The learned advocate for the petitioner makes a grievance that the respondents 1 and 2 are not granting continuity of service as directed by this Court and the salary of the petitioner pursuant to his reinstatement is also not paid. The learned advocate for the respondent - Management has submitted that the bills of salary of the petitioner from 1st July, 2015 have been sent to the office of the Education Officer. In these circumstances, in my view, the grievance made by the petitioner is pre-mature. Accepting the statement made on behalf of the respondent - Management that the continuity of service would be given to the petitioner as per the directions of this Court, the contempt petition is disposed. Notice is discharged. No costs.
JUDGE Tambaskar.
