The learned Counsel for the Petitioner submits that the order passed by the Central Administrative Tribunal proceeds on the basis that the staff being surplus and the Petitioner being junior-most employee, the Petitioner was transferred to Gondia. The learned Counsel submits that after filing of the Petition, the Petitioner has come in possession of the documents which will demonstrate that the Petitioner is not junior-most employee in the Department. The learned Counsel submits that these documents were not placed before the Tribunal and the Petitioner is desirous of invoking the power of review of the Tribunal and seeks leave to withdraw the Petition to pursue the said remedy. 2.

The Writ Petition is disposed of as above.
