Adv. Harode as also Adv. Sudame appearing for contesting parties have no objection and in fact, they suggest that a competent Mediator should be appointed to look into the dispute. Shri Fulzele, learned Additional Public Prosecutor appearing for respondent nos.1 to 3, does not object to appointment of Mediator. He, however, submits that in that situation, present proceedings need not be kept pending and if mediation fails, liberty should be given to aggrieved party to proceed further in accordance with law.
2107wp413.16 2/2 We find substance in the contentions of learned Additional Public Prosecutor.
Accordingly, we direct Registry of this Court to appoint Mediator for mediation in dispute between the parties.
Though only for the purpose of mediation, the present proceedings shall be looked into, after conclusion thereof, the parties shall be free to file appropriate proceedings in accordance with law. With the above observations and directions, we dispose of criminal writ petition. JUDGE JUDGE khj
