Perused contents of paragraphs 2 to 4 of the application. The record indicates that on 21/10/2016 the appellant had sworn an affidavit in support of the appeal. The appeal has been filed subsequently as the required certified copies were not available.

The prayer is opposed by the learned counsel for the non-applicants on the ground that the reasons mentioned are not sufficient.

Considering the fact that there is an affidavit dated 21/10/2016 on record, reasons mentioned in application are acceptable. Hence the delay in filing the Second Appeal stands condoned. Civil Application is allowed and disposed of. JUDGE Asmita
