This is an application for suspension of sentence and for grant of bail under Section 389 of the Code of Criminal Procedure.

The applicant/appellant is convicted by the judgment and order dated 12th April, 2016 by the POCSO Court for an offence punishable under the POCSO Act and sentenced to imprisonment for three years and to pay fine of Rs.3000/-.

It is brought to my notice that the appellant/applicant was on bail during the trial and has already paid amount of fine as ordered.

The appeal is already admitted.

in view thereof, the sentence is suspended. The criminal application is allowed. The applicant be released on bail on the terms and conditions on which he was released on bail in the trial court.
