At the outset, he submits that since an application under Section 44 of the Maharashtra Regional and Town Planning Act, 1966 is pending before the concerned authority, he wants to withdraw the present writ petition with liberty to file afresh. 3.

The writ petition is disposed of as withdrawn with liberty to file afresh, if occasion arises. No costs.
