By this petition, the petitioner challenges the order of the respondent no.1 so far as it brings only thirty students on grantin-aid facility in the school for handicap, run by the petitionerSociety, in stead of forty. Shri Khubalkar, the learned Assistant Government Pleader appearing for the respondent nos.1 and 2, states, by relying on the affidavit-in-reply filed on behalf of the respondent nos.1 and 2 and further instructions received by him, that the Government has called for a report from the Commissioner, Handicap Welfare and the strength of the students from the original record would be considered for 123 special schools and the dispute would be resolved after considering the data in the certificate of registration and its renewal from time to time. It is submitted that an appropriate decision may be taken by the respondent no.1 within a period of three months.
By accepting the statement made by the learned Assistant Government Pleader, that would be binding on the respondents, we dispose of the writ petition with no order as to costs.
