This is an application for condonation of delay in filing appeal under Section 54 of the Land Acquisition Act. 2.

Heard learned Advocate for the applicant. He submits that the department desired to file appeal challenging the judgment and award dated 21-12-2022, however some time was consumed in obtaining necessary approval and legal opinion and to arrange the Court fees. He submits that delay of 405 days is unintentional and needs to be condoned so that the appeal is decided on merits.

Having regard to the contents of the civil application and the submissions advanced, the delay does not appear to be intentional. It is desirable that the appeal is decided on merits and therefore the delay needs to be condoned. The delay of 405 days in filing the appeal is condoned.
