DATE : 1.7.2015 This application is filed by the seven applicants seeking permission to participate in the proceedings of the writ petition as intervenors. It is submitted that the applicants are directly connected with the affairs of the Society/Bank and the applicants had filed Public Interest Litigation No.25/2014 before this Court praying that the Authorities be directed to conduct the enquiry under Section 88 of the Maharashtra Co-operative Societies Act, 1960 within the stipulated time. It is submitted that the public interest litigation was entertained

2 caw1227.15 by this Court and an order has been passed on 19th June, 2015 requesting the Single Judge to decide the present writ petition on the next date.

Shri Ghare, the learned advocate for the petitioner has opposed the application. It is submitted that the applicants/intervenors are neither necessary nor proper parties for the adjudication of the writ petition.

Considering the fact that the public interest litigation filed by the applicants has been entertained by this Court and an order has been passed in that public interest litigation requesting that this petition be disposed on the next date, in my view, the applicants have some concern with the subject matter. Though their presence as respondents will not be necessary, in my view, they can be permitted to participate in the proceedings of this writ petition as intervenors which may be of assistance for deciding the writ petition. The civil application is allowed in terms of the prayer made in the civil application.
