Heard Shri P.S. Patil, learned counsel for the petitioner, Shri A.A. Madiwale, learned AGP for respondent No. 1, Shri R.S. Charpe, learned counsel for respondent No. 2.

The petitioner, who has joined employment on 05.10.1989 has approached this Court for protection of his employment in view of communication dated 25.04.2017, giving him last chance to submit caste verification. 3.

This Court has on 12.05.2017 protected his employment.

The learned counsel for respondent No. 2 - Employer fairly states that caste claim is still pending. 5.

The learned AGP submits that his instructions are still awaited.

As the caste claim is still pending, employment of the petitioner cannot be disturbed.

In this situation, we direct Respondent No. 1 - Scrutiny Committee to expedite consideration of caste claim and to take suitable decision upon it in next one year.

2306wp2924.17 Respondent No. 2 - employer shall not take any action to the prejudice of employment of the petitioner without serving him a previous notice of one month in this respect. The impugned communication is accordingly quashed and set aside.

Writ Petition is thus partly allowed and disposed of. However, there shall be no order as to costs. JUDGE JUDGE *GS.
