CRIMINAL APPLICATION NO. 495 OF 2019 .
This is an application for suspension of sentence and for grant of bail.

It is pointed out that the Sessions Court in the present case has imposed sentence upon the Yadav VG 1/2
11.Apeal.357.19 Appellant to suffer rigorous imprisonment for one year and to pay a fine of Rs.1000/-, in default to suffer simple imprisonment for one month for the offence punishable under Section 353 of Indian Penal Code. The Sessions Court further sentenced the Appellant to pay a fine of Rs.500/-, in default to suffer simple imprisonment for 15 days for the offence punishable under Section 186 of Indian Penal Code.

It is also pointed out that already the fine amount has been paid and that throughout the proceedings before the Sessions Court, the Applicant - Appellant was on bail and he had never misused the liberty.

In view of above, the Application is allowed in terms of prayer clause - (i).

The sentence imposed upon the Applicant - Appellant by the Sessions Court is hereby suspended and he is directed to be released on bail on the same conditions, which were imposed by the Sessions Court during the pendency of trial.

Criminal Application stands disposed of accordingly.
