It is pointed out by Mr. Dhore, the learned Counsel appearing for the Revision-Applicant that in the Revision Application filed by the main accused in the same offence, this Court has already granted bail. 2.

It is also pointed out that the appellate court in the present case partly allowed the appeal and acquitted the Applicant for an offence punishable under Section 379 of the Indian Penal Code and held him guilty only for an offence punishable under Section 26(1)(a)(f) of Indian Forest Act and thereby reduced the sentence from six months to three months of simple imprisonment.

It is pointed out that already the fine amount has been deposited by the Revision-Applicant. 4.

In the light of above, issue notice to the Respondent, returnable after six weeks.

Ms. Deshmukh, the learned APP waives service of notice on behalf of Respondent - State. 6.

Present Revision Application to be tagged with Criminal Revision No. 105 of 2019.

CRIMINAL APPLICATION NO. 158 OF 2019 .

This is an application for suspension of sentence and grant of bail to the Applicant.

In view of the reasons noted above, this Application is allowed as prayed.

Consequently, the sentence is suspended and the Applicant is directed to be released on bail upon executing PR Bond of Rs.10,000/- with surety in the like amount.

Criminal Application stands disposed of accordingly.
