All these applications are disposed of by common order as the applicant seeks pre-arrest bail apprehending arrest in connection with the three different crimes registered against the applicant vide Crime Nos.129/2016, 44/2017 and 3/2017 for the offence punishable under Sections 409 and 420 read with Section 34 of the Indian Penal Code and Section 3

2 aba203.17 of the Maharashtra Protection of Interests of Depositors (in Financial Establishment) Act, 1999.

The crimes are registered on complaints filed by different complainants levelling similar accusations against the applicant.

The crimes are registered against the applicant and her husband on the complaints that the applicant and her husband had been running investment scheme, have lured investors to deposit the amount with them and they have not returned the money.

The learned Advocate for the applicant has submitted that the applicant is in government service working in I.T.I. Sakoli, Distt. Bhandara and she is not connected with business of her husband. The husband of applicant is arrested and is in jail. The applicant, woman, aged about 35 years, claims that she is not involved in any other crimes / offence.

This Court has passed order on 3rd April, 2017 (in Criminal Application [ABA] Nos.203/2017 and 204/2017) and on 26th May, 2017 (in Criminal Application [ABA] No.334/2017) granting protection to the applicant imposing condition of attendance at the police station. The non-applicant has not complained that applicant has not co-operated with it.

In the facts of the case, the order passed by this Court on 3rd April, 2017 (in Criminal Application [ABA] Nos.203/2017 and 204/2017) and on 26th May, 2017 (in Criminal Application [ABA] No.334/2017) granting protection to the applicant is confirmed.
