Heard learned counsel Shri Sharad Thakare for the applicant and learned Assistant Government Pleader Shri I.J. Damle for non-applicant No.2.

An appeal was filed by the MIDC vide First Appeal No.255/2014 before this Court. The said appeal was admitted. However, within the stipulated period, the applicant could not file private paper-book. Therefore, the appeal was dismissed for want of prosecution. Therefore, the applicant moved an application for restoration of the said appeal. However, there was delay of 276 days in moving the restoration application. 3.
On 10.8.2018, Notices on these two applications were issued. Though non-applicant No.1 is served, nobody is appearing on his behalf.

Learned counsel Shri Sharad Thakare for the .....2/-
cao1436.18 and mca st.10677.18 31 applicant submits that he will be filing the private paper-book within a period of 10 days from today. The statement is accepted.

Hence, both the applications are allowed. Delay is hereby condoned. The first appeal is restored to file. 6.
Both applications are allowed and disposed of accordingly.
