Both the learned counsels Shri M.V. Mohokar for the petitioner and Shri D.M. Kakani, for the respondent agree that the petition can be disposed of with the following order:
(1) The respondent - management shall be free to proceed with and conclude the inquiry.
(2) However, if a finding of guilt is returned, the punishment which the respondent - management may propose to inflict, may not be given effect to for a period of two weeks from the date of its communication to the petitioner. The inquiry shall be completed within three months and both the employee and the management shall cooperate with the Investigating Officer in expeditious disposal of the inquiry.
The petition is disposed of accordingly.
