Heard Ms. B.P. Bagade, learned counsel for the petitioner and Shri A.V. Palshikar, learned AGP for the respondents.

The petitioner has failed to produce any documentary proof or other evidence to demonstrate that, on relevant date, family of her father was residing in that area of erstwhile Central Provinces, which now is part of Maharashtra State.

In this situation, as the petitioner has failed to discharge burden caste upon her by Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance & Verification of) Caste Certificates Act, (Act No. 23 of 2001), we cannot find fault with the impugned order.

The petitioner has to approach the Competent Scrutiny Committee, having jurisdiction to verify her caste claim. We, therefore, dispose of the present writ petition. No order as to costs.
