Heard Shri Deshpande, learned counsel for the applicant and Shri Ghodeswar, learned Additional Public Prosecutor for the non-applicant / State, through Video conferencing.

The applicant is said to be arrested in Crime No. 138/2020 registered at Police Station Civil Lines, Akola for the offence punishable under Sections 302, 143, 147, 148, 149 and 504 read with Section 34 of the Indian Penal Code.

The prosecution case is that the present applicant along with seven others committed double murder and also injured the informant by using iron pipe, spade and wooden sticks and kicks and blows.

I have read the First Information Report and the statements of witnesses with the help of learned both the counsel. I have also perused the affidavit-in-reply filed on behalf of the state.

Although it is the case of double murder with multiple injuries, however, as far as role of the present applicant is concerned, firstly F.I.R. doesn' t found his name mention. He is referred as son of Painter Ingle in the F.I.R., however, the prosecution could not point out from the charge-sheet that son of Painter is the present applicant Satish Ingle. Even there is no specific role attributed in the statements of witnesses against the applicant.

Considering the nature of material against the present applicant, on stringent condition he can be released on bail. Hence, I pass the following order : (i) The applicant - Satish Sevanand Ingle be released on bail on executing Personal bond of Rs. 30,000/- with one surety in like amount.

(ii) The applicant to supply mobile numbers and address of his three close relatives to the concerned police station.

(iii) The applicant shall not enter the vicinity of the area where the witnesses reside.

(iv) The applicant shall not leave his local jurisdiction without prior intimation to the concerned police station.

(v) The applicant shall not give threats to the witnesses or tamper with the evidence. (vi) The applicant to attend the concerned police station once in a month i.e. on every first Wednesday of the month between 12.00 noon and 2.00 p.m.

(vii) Needless to say that the aforesaid observations are only for the purpose of deciding this application and the same shall not come in the way of the trial Court to decide the trial.

The criminal application is disposed of accordingly.
