IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR Writ Petition No.4582 of 2019 Shri Sudam S/o Dattuji Waghmare

Versus

State of Maharashtra, through its Desk Officer, Mantralaya, Mumbai, and others. Office Notes, Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders and Registrar's order Shri S.K. Thengre, Advocate for Petitioner.

Ms M.A. Barabde, Assistant Government Pleader for Respondent Nos.1 to 7, 11 and 12.

Coram : R.K. Deshpande & Vinay Joshi, JJ.

Date : 3rd July, 2019 Writ Petition No.1283 of 2019 filed by the petitioner for allotment of land in question was dismissed by this Court on the ground that the rejection of allotment was on the basis of the provision of Section 22A(1) of the Maharashtra Land Revenue Code, 1966 and the Government Resolution dated 12-7-2011. The said writ petition was dismissed on 15-2-2019. Now the petitioner is challenging the allotment of the same land to the respondent No.9- Society, granted on lease during the period from 1957 to 2017. We fail to understand the locus of the petitioner, and apart from it, the petitioner should have raised this challenge in Writ Petition No.1283 of 2019, which he had filed, challenging the rejection of allotment. The petition is dismissed.
