Heard.
The applicant is arrested on 20th October, 2016 in connection with crime registered against him and co-accused Kamlesh for the offences punishable under Sections 302, 307, 323 read with Sections 34 of the Indian Penal Code. According to the Investigating Agency, the accused went to the house of deceased and on some issue regarding cell phone started quarrel with him and assaulted him by fists and kicks and wooden rod and deceased succumbed to the injuries.
The applicant, aged about 30 years, claims to be a labourer and has stated that he is not involved in any other crime/offence. The co-accused Kamlesh is released on bail as per the order passed by this Court.
The investigation is complete and charge-sheet is
2 ba466.17 filed on 11th January, 2017. The non-applicant has not been able to point out that the custody of the applicant is required for further investigation.
In the facts of the case, following order is passed : The applicant having been arrested in connection with Crime No.805 of 2016 registered by the non-applicant, he be released on bail on executing P. R. Bond of Rs.25,000/- and furnishing two solvent sureties in the like amount. The applicant shall attend the trial before the Sessions Court regularly on every date unless granted exemption by the Sessions Court.
