The accused is convicted of sexual molestation of 11 years old child.

It is not in dispute that for similar offences the accused was convicted and he has undergone the sentence. 3.

In view of the previous conviction of the accused, I was not inclined to suspend the sentence. At this stage, Shri C.R. Thakur, the learned counsel for the accused seeks leave to withdraw the application unconditionally.

The application is disposed of as withdrawn unconditionally.

However, since the sentence is not being suspended, the appeal shall have to be heard early. The record is received.
