IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH AT NAGPUR WRIT PETITION NO.5270/2015 Akola Education Society, through is President, Akola ...Versus...

Deshpande, Advocate for petitioner Ms Tajwar Khan, AGP for respondent nos.1 and 2 CORAM : SMT. VASANTI A. NAIK AND A.I.S. CHEEMA, JJ.

DATE : 14.10.2015 The only prayer made by the petitioner is for a direction to the respondent no.1 - Divisional Commissioner to decide the revision bearing No.AES/MLCASE/A-C-A/139 dated 1.9.2014 within a period of one month.

Prima facie, we were of the view that there was no provision for filing the revision in the matter of the petitioner. Some time was therefore granted to the learned Counsel for the petitioner to point out whether the remedy of revision was available and the provision under which it could be availed. The learned Counsel for the petitioner fairly states that there is no remedy of revision, available to the petitioner.

1410wp5270.15.odt If that be so, the prayer made by the petitioner for a direction to the respondent no.1 to decide the revision within a time frame cannot be granted. The petitioner is free to avail the remedy available to the petitioner, in law.

The writ petition is disposed of with no order as to costs.

JUDGE JUDGE Wadkar
