Heard.
The applicant is arrested on 14th October, 2016 in connection with crime registered against him and Ten others for the offences punishable under Sections 143, 147, 148, 302, 324, 120-B of the Indian Penal Code.
According to the Investigating Agency, the accused formed an unlawful assembly and assaulted deceased Sanjay Mandhare by stick and bat. According to the Investigating Agency, the applicant assaulted the victim by stick.
The applicant, aged about 22 years, claims to be a labourer and has stated that he is not involved in any other crime/offence. Seven accused have been released on bail as per the order passed by the Sessions Court on 16th January, 2017. The investigation is complete and charge-sheet is filed on 6th January, 2017. The non-applicant has not been able to
2 ba470.17 show that the custody of the applicant is required for further investigation.
In the facts of the case, following order is passed : The applicant having been arrested in connection with Crime No.390 of 2016 registered by the non-applicant, he be released on bail on executing P. R. Bond of Rs.25,000/- and furnishing two solvent sureties in the like amount. The applicant shall attend the trial before the Sessions Court regularly on every date unless granted exemption by the Sessions Court.
The application is allowed in the above terms. CRIMINAL APPLICATION (APPP) NO.853 OF 2017.
In view of disposal of the main application, the application for grant of time to file affidavit of relative and copy of charge-sheet has become infructuous.
The Criminal application is disposed of accordingly.
