DATE : 07.05.2025 Present application is filed for grant of permission to respondent to withdraw the occupational charges deposited by the petitioner. It appears that both the parties arrived at an amicable settlement and filed joint pursis bearing Pursis Stamp No. 3/2025, before this Court. This Court vide order dated 07/03/2025, disposed of both the Writ Petition Nos. 521/2024 and 2761/2024. In terms of compromise arrived at between the parties, as per Clause - 3 of the terms, the tenant in compliance of the order dated 29/01/2024, by this Court, has deposited Rs.72,000/-, before this Court. He has given his consent and no objection to the landlord (present applicant - Sharad Mahadeo Mahajan) for withdrawal of the said amount of Rs.72,000/-. As such, in view of the settlement term, Clause - 3, there is no impediment in granting permission for withdrawal of the said
(2) 903 caw 1079-2025 amount. Accordingly, Nazir is directed to release the amount of Rs.72,000/-, deposited as per order dated 29/01/2024, along with accrued interest in favour of present applicant - Sharad Mahadeo Mahajan, after due verification of bank details.
