For the reasons stated in the application, the original complainant (prosecutrix) is permitted to assist the prosecution.

CRIMINAL APPLICATION (ABA) NO.341 OF 2017.

Heard.

Apprehending arrest in connection with Crime No.249 of 2017 registered for the offence punishable under Section 376 of the Indian Penal Code, the applicant has sought pre-arrest bail.

The crime is registered on the complaint lodged by the prosecutrix, aged about 35 years, that the applicant and prosecutrix are working at the same place and had been

2 aba341.17 knowing each other and taking advantage of this fact, the applicant developed friendship with the prosecutrix and assuring to marry her, sexually exploited her. According to the prosecutrix, the incident is of January, 2016. The complaint is lodged on 6th May, 2017.

This Court has granted interim protection to the applicant by order passed on 23rd May, 2017 imposing condition of attendance at the police station. It is not the complaint of the Investigating Agency that the applicant has not co-operated with it. The non-applicant has not been able to point out that custody of the applicant is required for further investigation.

In the facts of the case, following order is passed: In the event of arrest in connection with Crime No.249 of 2017 registered by the non-applicant, the applicant be released on bail on executing P. R. Bond for Rs.20,000/-. The application is allowed accordingly.
