Apprehending arrest in connection with crime registered by the non-applicant for the offence punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, the applicant has sought pre-arrest bail.

According to the Investigating Agency, stock of liquor is seized from the house of co-accused Lovkesh Raju Kumbhalwar and during interrogation, he disclosed that liquor is supplied to him by the present applicant. The application is opposed on the ground that custodial interrogation of the applicant is necessary to trace the supplier of liquor in Chandrapur District where sale of liquor is prohibited. The learned A. P. P. has pointed out that earlier also crime for similar offence is registered against the applicant.

2 aba342.17 The learned advocate for the applicant has submitted that the stock of liquor is not seized from the applicant or from the house of the applicant. Considering the facts of the case, following order is passed :

In the event of arrest in connection with Crime No.737 of 2017 registered by the non-applicant, the applicant be released on bail on furnishing cash security of Rs.50,000/- and one solvent surety in the like amount.
