The applicant is arrested on 18th April, 2015 in connection with crime registered against him and five others for offence punishable under Sections 363, 366, 376(2)(i), 344, 372 and 373 read with Section 34 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act.
The crime is registered on the complaint lodged by Raju Chicham, father of victim, (aged about 15 years) that the applicant and his wife had been to his house when the victim was alone, told her that the complainant had asked them to take the victim alongwith them to secure a job for her and on this pretext the applicant and his wife took the victim to Madhya Pradesh where they stayed at the house of co-accused Mahesh Barman and on next day the victim
2 ba474.17 was handed over to Bablu Koge (Balai) with whom the marriage of the victim was performed forcibly and then Bablu Koge (Balai) sexually assaulted the victim. The learned Advocate for the applicant has submitted that the F.I.R. is lodged after about a month. The investigation is complete and charge-sheet is filed on 9th November, 2015. The applicant is in jail for about 22 months. The non-applicant has not been able to show that further custody of applicant is required for investigation. The applicant, aged about 27 years, claims to be in private service, is married and claims to be permanent resident of Katol.
In the facts of the case, following order is passed:
The applicant having been arrested in connection with Crime No.145/2015 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.20,000/- (Rs. Twenty Thousand) and furnishing one solvent surety in the like amount. The application is allowed accordingly.
