DATED : 21-02-2022 The learned Counsel for respondent 2 Mr. Bhoyar states, on instructions received, that the order of dismissal dated 13-2-2020 shall be withdrawn and a departmental enquiry shall be conducted pursuant to the charge-sheet dated 18-2-2020.

In view of the statement made supra, the petition is disposed of.

In this view of the matter, the validity of the dismissal order need not be looked into. The employee shall be deemed to be in service and on suspension. He shall be entitled to suspension allowance, in accordance with the rules.
