Prayer is to grant permission to amend the petition. It is stated that during pendency of the Writ Petition the property in question has been sold to one Vijay Pundlikrao Deshmukh and hence the petitioners seek permission to substitute the name of respondent no.2 with that of Vijay Pundlikrao Deshmukh. Hence, considering the reasons assigned the application for amendment is allowed. Amendment be carried out forthwith Civil Application stands disposed of.

Civil Application No. 178 of 2013: In the application it is stated that on 18.03.2013, a fresh lease for a period of 30 years has been executed by respondent no.2 in favour of the petitioner. Lease amount of Rs. 25,000/- per month has been agreed. It is, therefore, stated that the cause for prosecuting the present proceedings does not survive.

0902wp3210.05 Considering the aforesaid developments, it is clear that in these circumstances there is no occasion to consider the challenge to the impugned order. Hence, in terms of prayer made in the civil application the Writ petition is permitted to be withdrawn and the civil application stands disposed of. Rule stands discharged accordingly. No costs.
