Heard.

The applicant, apprehending arrest in crime registered against him for the offence punishable under Sections 3 and 7 of the Essential Commodities Act, has sought pre-arrest bail.

The crime is registered on the complaint lodged by an official from Tahsil office that the applicant has not distributed food-grains in the quantity for which the beneficiaries of the Antyodaya Yojna are entitled. The application is opposed on the ground that investigation is in progress.

Considering the nature of accusations against the applicant and as in the facts of the case, in my view, the custody of the applicant will not be required for further investigation, following order is passed: In the event of arrest in Crime No.57/2017

2 aba351.17 registered by the non-applicant, the applicant be released on bail on furnishing cash security for Rs.1,00,000/- (Rs. One Lakh) and one solvent surety in the like amount.
