DATED : JULY 26, 2021 Heard Mrs. Charlewar, learned counsel for petitioner, Mr. Mirza, learned A.P.P. for respondent nos. 1 to 4 and Mr. Dafle, learned counsel for respondent no.6. In the reply, the State authorities have made a statement on oath that investigating officer has filed 'C' Summary before the learned Magistrate and that is yet to be accepted by the learned Magistrate.
In view of the statement on oath made in paragraph 7 of the reply, we dispose of this writ petition with liberty to the petitioner to file Protest Petition before the learned Magistrate, if he is entitled to file such a Protest Petition.
The writ petition is disposed of.
