IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT NAGPUR, NAGPUR.
...
WRIT PETITION NO. 3080 OF 2010 Mr.Karbhari Asaram Mundhe ..Petitioner versus Union of India and Others ..Respondents None for the Petitioners Mr.S.A.Chaudhari, Advocate for Respondent Nos. 1 to 3 CORAM: NITIN JAMDAR & ANIL L. PANSARE JJ.
DATE : 02 MAY 2022 P.C. :
None for the Petitioner.
2.
The Petitioner was selected in the Central Reserve Police Force on 11 July 2000 on the post of Constable/General Duty and was sent for basic training at Pune. Standing Order was issued by the Respondent Director General of CRPF regarding medical categorization and invalidation of Central Reserve Force Personnel on 15 December 2008. An issue arose regarding the CRPF personnel with colour blindless. A Circular/letter was issued on 29
2 WP.3080.10 October 2008 by the Respondents that those with colour blindness should be adjusted on non-technical post.
3.
When the Petition was filed in the year 2010 the Petitioner was 32 years old. There was no interim relief granted. 4.
The learned Counsel for the Respondent Nos. 1 to 3 produced on record a Office Order dated 15th October 2011 issued by the Deputy Inspector General, CRPF, Nagpur, stating that personnel employed with colour blindness before 17 May 2002 may be placed under medical category E-2 instead of E-5 and they would also be eligible for promotion. The Petitioner being recruited before 2002 will be eligible for promotion as per his eligibility. The Office Order is taken on record. It is perhaps for this reason that none appears for the Petitioner, having lost interest in prosecuting this petition.
5.
The writ petition is accordingly disposed of as infructuous. Rule discharged.
