There is an appeal provided under Rule 14 of the Maharashtra Zilla Parishads District Services (Discipline and Appeal) Rules, 1964 to the Divisional Commissioner. It is urged that the enquiry in the present matter was made by the Additional Commissioner. In view of this, the appeal will have to be dealt with the Commissioner without delegating the power to the Additional Commissioner, who conducted the enquiry.

The petitioner is permitted to withdraw this petition with liberty to approach the Divisional Commissioner by filing of appeal. All questions raised in this petition are left open. (Vinay Joshi, J.) (R.K. Deshpande, J.) Gulande
