It is submitted that due to inadvertence the pendency of the present civil application could not be pointed out.

None appears for the non-applicants.

Considering the fact that even the non-applicants had not raised any objection on 13-01-2016 on the point of delay and considering the facts of the case, the delay of forty-one days in filing the miscellaneous civil application is condoned.

Civil application is allowed.
