Heard Shri V.A. Thakare, learned A.P.P. for the applicant/appellant and Shri S.A. Chaudhari, learned Counsel for non-applicants/respondents. 2.
Learned A.P.P. states that the delay is of 57 days and it has occasioned due to correspondence required to be completed.

Learned Counsel for respondents is seeking time to file reply. He submits that at some places there is huge gap between two developments.

The prayer for condonation of delay is on the basis of records in custody of the applicants, as
Order 1412appa363.15 such, we are not inclined to grant time to the respondents to file reply. Various dates disclosed in the affidavit show that steps were constantly being taken for filing the appeal. It is not in dispute that respondents' appeal under Section 374 of Criminal Procedure Code challenging their conviction in the same matter has already been admitted by this Court. 5.
In this situation, Criminal Application No.363/2015 is allowed and disposed of. Office to register Appeal and place the same for admission. No costs.
