BA NO. 486/2016 :

Heard learned Counsel for the applicant and learned A.P.P. for the State assisted by the learned Counsel for the complainant. Perused the reply of the prosecution and the case-diary.

Learned Counsel for the applicant submits that Gajanan, who is alleged to have executed the plan to eliminate the deceased Pralhad has been released on bail

2 1608ba486.16 on the ground that the prosecution material disclosing his role in killing the deceased was shaky in nature. These applicants have been implicated on the allegation that they gave contract of killing to Gajanan so that they could carry on with their alleged illicit relationship without any hindrance. But, if the evidence against coaccused Gajanan itself has been prima facie found to be discrepant, at this stage, I am of the view that no purpose would be served by keeping these applicants behind the bar for any further period of time. Hence, the order. The application is allowed and it is directed that the applicants be released on bail on each of them executing a P.R. Bond in the sum of Rs.25,000/- together with one solvent surety in the like amount on the conditions that the applicants shall attend regularly the Court on the dates fixed in the matter, shall cooperate with the Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses in any manner.
