The petitioner is challenging order dated 23-5-2017 passed by the Divisional Commissioner, Amravati Division, Amravati rejecting the application seeking stay to the order passed by the Additional Collector-respondent 2 dated 04-5-2017, by and under which the petitioner is disqualified as Member of GramPanchayat due to failure to furnish the Caste Validity Certificate within the stipulated time.

The issue is covered by the decision of the Hon'ble Apex Court in Shankar s/o Raghunath Devre (Patil) Vs. State of Maharashtra & Ors. in Special Leave to Appeal (C) No(s) 29874-29875/2015 which approves the Full Bench decision of this Court in Anant H. Ulahalkar and another vs. Chief Election Commissioner and others reported in 2017(1) Mh.L.J.
