ORDER

(Passed on 13/07/2019) The advocate representing the appellant is present. The respondents are absent.

The appellant has filed Pursis 'X' stating that the amount due has been deposited by the appellant in the Court and it has no objection to withdraw the same by the respondents/claimants. The appellant has also filed Pursis 'Y' for claiming/refunding of the Court fee.

Although the respondents are absent, it is reported that no cross appeal or objection is pending at the instance of the respondents. There is no reason to refuse this withdrawal.

Hence, the appeal is allowed to be withdrawn in terms of Pursis 'X'. The admissible Court fee, as per the Rules, be refunded to the appellant. The respondents/claimants are allowed to withdraw the amount deposited by the appellant.

The appellant is directed to inform the respondents/claimants about this order immediately.
