At the outset, Mr. Jawade, learned A.P.P. submits that permission may be granted to the applicant-State to withdraw the present revision in order to file the revision before the learned Sessions Judge since the State is challenging the order of discharge passed by the learned Magistrate.
The prayer is accepted.

The revision application is allowed to be withdrawn with liberty to the applicant-State to file revision application before the Sessions Court to challenge the order of discharge. If the revision is filed along with an application for condonation of delay, said application shall be decided by the revisional Court, in accordance with law, keeping in mind the relevant provisions of the Limitation Act. The revision application is disposed of accordingly.
